These Terms of Service (“Terms”) govern access to and use of https://terraviqo.com and its related online store, content, features, products, and services collectively referred to as the “Services.”

The terms “Terraviqo,” “we,” “us,” and “our” refer to Terraviqo, the operator of the Services. Our ecommerce store is hosted by Shopify, which provides the platform through which we make the Services available.

By accessing or using the Services, creating an account, or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree to these Terms, you should not use the Services.

1. Eligibility and Account Information

You must be at least the age of majority in your province, state, or country of residence, or have the permission and supervision required by applicable law, to use the Services.

When creating an account or placing an order, you agree to provide current, accurate, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Please notify us promptly if you believe that your account or payment information has been accessed or used without authorization.

If there is a conflict between these Terms and a policy dealing specifically with a particular subject, the subject-specific policy will apply to that matter, subject to applicable mandatory law.

3. Products and Product Information

We make reasonable efforts to ensure that product titles, descriptions, photographs, prices, specifications, materials, care instructions, measurements, size information, availability, and other product details are accurate and current.

Product colours may appear differently because of photography, lighting, screen settings, display technology, or normal manufacturing variations. Measurements and size guidance are approximate unless expressly stated otherwise.

Customers should review the complete product page, including the product description, materials, care information, dimensions, available variants, price, and estimated delivery information, before placing an order.

We do not claim that a product is manufactured, designed, or sourced in Canada unless the relevant product page expressly and accurately states that fact. Brand, origin, environmental, certification, performance, health, or safety claims apply only when accurately stated and supported for the relevant product.

Product availability may change without notice. Displaying a product on the website does not guarantee that it will remain available until an order has been accepted.

4. Prices, Currency, Taxes, and Promotions

Prices are displayed and charged in the currency shown for the customer’s selected market. The applicable product price and currency will remain consistent on the product page, in the shopping cart, and throughout checkout, except where a valid discount or promotion is applied before payment.

Applicable taxes and any other mandatory charges will be displayed before the customer submits the order.

Free standard shipping applies to every order accepted through our checkout, with no minimum purchase requirement. Import duties, import taxes, customs charges, brokerage fees, or other destination-related government charges not collected at checkout are handled as described in our Shipping Policy.

Prices and promotions may change prospectively without notice. Changes will not affect an order that has already been accepted unless the customer agrees or applicable law requires otherwise.

Any discount, reference price, sale price, stock level, countdown, limited-availability statement, or promotional offer displayed through the Services will apply only when it is genuine, current, and accurately described.

If a material pricing, currency, product-description, or listing error is identified before an order is accepted, we may contact the customer and offer the choice to proceed with the corrected information or cancel the affected order for a full refund. We will not substitute a different price after an order has been accepted without the customer’s agreement.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products. An automated order confirmation acknowledges that we have received the order but does not necessarily mean that the order has been accepted.

An order is accepted when we confirm fulfillment or dispatch, or otherwise expressly confirm acceptance, subject to applicable law.

We may refuse or cancel an order for a legitimate reason, including:

• Product unavailability;

• Payment failure or payment authorization issues;

• Suspected fraud or unauthorized activity;

• Delivery restrictions;

• A material pricing or listing error;

• An incorrect or incomplete delivery address;

• Violation of these Terms; or

• Circumstances preventing lawful or reasonable fulfillment.

If we cancel an order after payment has been captured, the amount paid for the cancelled item or order will be refunded to the original payment method.

We may limit or cancel quantities purchased per person, household, account, payment method, billing address, or order where reasonably necessary to prevent fraud, unauthorized resale, inventory abuse, or other misuse.

6. Payment

The payment methods currently accepted are displayed during checkout. Customers may only use a payment method they are legally authorized to use.

By submitting payment information, you authorize the applicable payment provider to charge the total amount shown before order submission, including the product price, applicable taxes, and any clearly disclosed mandatory charges.

Payment information is processed securely by Shopify and authorized third-party payment providers in accordance with their applicable terms and privacy practices. Terraviqo does not ordinarily receive or store complete payment-card numbers.

We will not charge a payment method that has not been selected and authorized by the customer.

If a payment cannot be authorized or is later reversed, disputed, or identified as potentially fraudulent, we may suspend fulfillment, request reasonable verification, or cancel the affected order.

7. Shipping and Delivery

Orders are normally processed within 1–3 business days after payment authorization and order confirmation. Business days are Monday through Friday, excluding Canadian public holidays.

After dispatch, standard delivery normally takes 7–15 business days. The estimated total time from confirmed order to delivery is therefore 8–18 business days.

Free standard shipping applies to every order accepted through our checkout, with no minimum purchase requirement.

Delivery estimates are provided in good faith but are not guaranteed arrival dates. Delivery may be affected by carrier delays, customs inspections, severe weather, public holidays, peak periods, remote destinations, incorrect addresses, or other circumstances outside our reasonable control.

Complete information concerning shipping destinations, processing times, tracking, customs charges, delivery delays, lost packages, and returned parcels is provided in our Shipping Policy.

8. Returns, Refunds, Exchanges, and Cancellations

Eligible returns may be requested within 30 calendar days after the order is delivered.

Returned products must satisfy the eligibility conditions stated in our Return and Refund Policy. Customers must contact us and receive return instructions before mailing an item. Returns sent without prior authorization may be refused or delayed.

Terraviqo pays the reasonable approved return shipping cost when we verify that an item arrived damaged, defective, incorrect, or materially different from its description.

Customers are responsible for return shipping costs for preference-based returns, including change of mind, ordering the wrong size or colour, fit concerns, or no longer wanting the item.

Approved returns are not subject to a separate restocking fee.

After a return is received, inspected, and approved, the refund will be issued to the original payment method within 10 business days. A bank, card issuer, or payment provider may require additional time to post the credit.

Direct exchanges are not guaranteed because inventory may change. Complete return eligibility requirements, exclusions, procedures, shipping-cost responsibilities, inspection standards, cancellation rules, and refund timing are provided in our Return and Refund Policy.

Nothing in this section limits any non-waivable return, refund, warranty, or consumer-protection rights available under applicable law.

9. Customer Communications and Reviews

If you submit a review, photograph, video, comment, suggestion, testimonial, or other content through the Services, you represent that:

• You own the content or have permission to submit it;

• The content is accurate and lawful;

• The content does not infringe another person’s intellectual-property, privacy, publicity, or other rights; and

• The content does not contain malware, fraudulent material, harassment, or unlawful content.

You grant Terraviqo a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, and use submitted content in connection with operating and promoting the Services.

This licence does not transfer ownership of your submitted content to Terraviqo. Where applicable law requires separate consent for advertising or promotional use of personal information or images, we will obtain that consent.

We may remove submitted content that violates these Terms or applicable law.

10. Acceptable Use

You must not use the Services to:

• Violate any applicable law or regulation;

• Submit false, fraudulent, or misleading information;

• Conduct payment fraud or unauthorized transactions;

• Interfere with the operation or security of the website;

• Introduce viruses, malware, malicious code, or harmful technology;

• Attempt to gain unauthorized access to accounts, systems, or data;

• Scrape, reproduce, or commercially exploit website content without authorization;

• Infringe intellectual-property, privacy, or other legal rights; or

• Use the Services in a way that could harm Terraviqo, its customers, service providers, or other persons.

We may restrict or terminate access to the Services for a material violation of these Terms, subject to applicable law.

11. Intellectual Property

The Terraviqo name and original website design and content created by or for Terraviqo are owned by Terraviqo or its licensors and are protected by applicable intellectual-property laws.

Third-party trademarks, brand names, product images, and other third-party content remain the property of their respective owners and are used only where Terraviqo has authorization or another lawful right to use them.

Nothing in these Terms transfers ownership of any intellectual property to the customer. Content from the Services may not be copied, reproduced, distributed, modified, republished, or commercially exploited without authorization, except where permitted by applicable law.

The appearance of a third-party trademark or brand name does not by itself mean that the trademark owner sponsors, endorses, operates, or is affiliated with Terraviqo.

12. Third-Party Services and Links

The Services may use or contain links to independent third-party services, including Shopify, payment providers, delivery carriers, analytics providers, and other service providers.

Third-party services may be governed by their own terms and privacy practices. We are not responsible for independent third-party websites or content that we do not operate or control.

Nothing in this section limits Terraviqo’s responsibilities concerning an order, payment, product, refund, or other obligation that cannot lawfully be transferred or excluded.

13. Privacy

Our collection, use, processing, retention, and disclosure of personal information are governed by our Privacy Policy available through the website.

By using the Services, you acknowledge that personal information may be processed by Shopify, payment providers, fulfillment providers, carriers, and other authorized service providers as reasonably necessary to operate the store and complete transactions.

14. Disclaimer of Warranties

We make reasonable efforts to maintain the availability, security, and accuracy of the Services. However, website access may occasionally be interrupted for maintenance, security updates, technical problems, carrier issues, or circumstances outside our reasonable control.

To the fullest extent permitted by law, the Services are provided on an “as available” basis.

Nothing in these Terms excludes or limits any statutory warranty, condition, guarantee, remedy, or consumer right that cannot lawfully be excluded or limited.

15. Limitation of Liability

Nothing in these Terms limits or excludes any liability, warranty, guarantee, remedy, or consumer right that cannot lawfully be limited or excluded.

Subject to the foregoing and to the fullest extent permitted by applicable law, Terraviqo’s aggregate liability for a claim directly relating to a purchased product will not exceed the amount paid for that product.

Terraviqo will not be responsible for indirect or consequential losses that were not reasonably foreseeable when the order was placed, except where liability for such losses cannot lawfully be excluded.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify Terraviqo against reasonable third-party claims, losses, or expenses directly resulting from your unlawful misuse of the Services, infringement of another person’s rights, or material breach of these Terms.

This section does not apply to claims caused by Terraviqo’s own violation of law, negligence, misconduct, or failure to perform its obligations, and it does not limit any mandatory consumer right.

17. Electronic Communications

You consent to receive order confirmations, receipts, shipping updates, security notices, customer-service responses, policy notices, and other transactional communications electronically using the contact information you provide.

Marketing communications will be sent only where permitted by law and in accordance with your choices. You may unsubscribe from marketing emails using the unsubscribe link contained in those messages. Unsubscribing from marketing does not prevent transactional communications concerning an order, account, payment, delivery, return, or security issue.

18. Governing Law and Consumer Rights

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

This choice of law does not deprive consumers of any mandatory protections, remedies, or jurisdictional rights available under the laws applicable to them.

Nothing in these Terms limits any non-waivable rights or remedies provided by applicable consumer-protection law.

19. Severability and Entire Agreement

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will continue in effect.

These Terms and the policies incorporated into them constitute the agreement between the customer and Terraviqo concerning use of the Services and purchases made through the website.

A failure to enforce a provision immediately does not waive the right to enforce it later.

20. Changes to These Terms

We may update these Terms to reflect changes to our operations, Services, policies, legal obligations, or regulatory requirements.

The revised version will be published on this page with an updated “Last updated” date. Changes will apply prospectively from the effective date unless applicable law requires otherwise.

Changes will not retroactively alter the material terms of an order already accepted without the customer’s agreement, except where required by law.
